The Claimants made a claim for an interim payment in Group Litigation where the Defendants claimed that the litigation had not finished, because only judgments on common issues in favour of the Claimants had been made, and it was inappropriate to make an order for payment. Not all the Claimants would be able to proceed – 15 or 16 out of 18.
The Claimants submitted a schedule. The Defendants argued that some costs had been wasted. The sum or approximately £3million was claimed on account of common costs. The judge decided the Claimants should be entitled to 90%. To allow for differences at the final assessment an award of £1.6million was made.
